An alderman may review the budget, approve hiring of personnel, and approve payment of operating expenses for municipal court, where the alderman’s spouse is a member of a law firm and routinely represents parties in municipal court. Section 25-4-105(1), Miss. Code of 1972, prohibits the alderman from using his or her official position to obtain, or attempt to obtain, a pecuniary benefit for the alderman’s spouse and the law firm. However, the specific actions identified by the alderman will not result in a pecuniary benefit to the spouse or the law firm, under the facts provided by the alderman.
