Summary

An outgoing mayor may be employed by a law firm which also employs the city public defender. Under these particular circumstances, the mayor will not acquire a prohibited interest in the contract between the city and the public defender, and no violation of Section 109, Miss. Const. of 1890, or Section 25-4-105(2), Miss. Code of 1972, will occur. However, the mayor should fully recuse from any matter involving the public defender to comply with Section 25-4-101. After leaving office, the former mayor may represent clients before the city when the matter originated after the mayor left office and the representation is not directly or indirectly authorized by the city, as set forth in Section 25-4-105(3)(e).
