A public school board of trustees may approve the sale of real property to a nonprofit organization when a school board trustee is also an employee of the nonprofit organization. The school board trustee will not have a prohibited interest in the transaction since it will not pay money to his employer or affect his compensation or job in any way, and no violation of Section 109, Miss. Const. of 1890, or Section 25-4-105(2), Miss. Code of 1972, will occur. Nevertheless, the trustee must recuse from any action by the school board related to the sale of property to this nonprofit organization to comply with Section 25-4-105(1).
